| To Plead Not Guilty: Read Section "B" in its entirety. If you are not in agreement with the reason you were issued the ticket and wish to contest the summons, this is the selection for you. Check the "Yes or No" box Under the Supporting Deposition Request. A Supporting Deposition is a form completed by the Officer who issued you the ticket. It re-iterates the circumstances under which you were issued the ticket and the Officer's observations at the time of the violation. Check the paperwork the officer gave you when he handed you your ticket, a supporting deposition may have been given to you on the roadside. (Click Here to see a sample Supporting deposition) If you did not receive the supporting deposition with the ticket and you would like to receive one, check "Yes" and a Supporting Deposition will be mailed to you by the Officer before your court date. If you did receive the supporting deposition with the ticket and you do not want one, check "No" and no action will be taken. Complete the remainder of Section "B" entering your mailing address and signature. When Section "B" is complete send the completed Ticket to the Court listed on the front. It is suggested you mail it to the court Registered or Certified Mail, Return Receipt Requested, or by First Class Mail. After you submit your not guilty plea to the Court, you will receive a notice in return from the court listing your Trial Date and Time. To Plead Guilty: Read Section "A" in its entirety. Complete Section "A" Entering The Location information and Court of Jurisdiction (Ticonderoga Town Court), Your Full Name, and address. Enter a short explanation, if you wish. Be sure to Sign and Date the bottom section of Section "A". Subjects under 18 Years of Age that were issued a Ticket Must submit the Name and Address of your Parent/Guardian on the bottom of the Ticket. Send the completed Ticket to the Court listed on the front. It is suggested you mail it to the court Registered or Certified Mail, Return Receipt Requested, or by First Class Mail. After you submit your guilty plea to the Court, you will receive a notice in return from the court listing your fine. Should your plea have been denied for some reason you will receive a notice to appear in court. |
If you were in a passenger vehicle and were issued a ticket for a violation of sections 375, 376 or 381 of the NYS Vehicle and Traffic Law the charge will be dismissed if proof is presented to the court that the defect was corrected prior to 1/2 hour after sunset on the first full business day after issuance of the ticket. If you were ticketed for a violation of one or more of these sections a Statement of Correction for Equipment Defect (fix-it ticket) should have been issued to you with the ticket. If you were in a commercial vehicle and were issued a ticket for a violation of the New York State Transportation Law section 14-f; 1NYCRR, Part 507 or Section 140-2d(ii); 17NYCRR, Part 820 the charge will be dismissed if proof is presented to the court that the defect was corrected prior to 1/2 hour after sunset on the first full business day, or if such complaint involves a farm vehicle registered persuant to Vehicle and Traffic Law Section 401 Sub 13 and operated in conformance with the terms of such registration, not later than 1/2 hour after sunset on the third business day after issuance of the ticket and proof of such correction is submitted to the court on or before the return date on the ticket. If you received a ticket for one or more of these offenses a Statement of Correction for Safety Violation New York State Transportation Law (Commercial fix-it ticket) should have been issued to you with the ticket. The Ticonderoga Town Court is in session every Wednesday. The first and third Wednsdays Hon. James O'Bryan begins court at 4:30PM and ends when the docket is clear. The second and fourth Wednesdays Hon. Keith Dolbeck hears cases beginning at 9:00AM until his docket is clear. The court clerk, Cindy Childs, is available 8AM to 4PM Monday through Friday to accept fines or returned tickets. The address and phone number to the court is listed below.
